ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 09.02.2023.

2. The contention of the petitioner is that the 4th respondent is his father and the 5th respondent is his junior paternal uncle and the schedule mentioned property is their ancestral property. The father of the petitioner/4th respondent along with the elder brother of the petitioner, sold the property to 5th respondent without the knowledge of the petitioner vide Doc. No.2225/2021 dated 27.07.2021 at the Sub-Registrar Officer, Chettikulam. Since the petitioner has also got a share in the property, on coming to know about the sale, the petitioner made a representation dated 09.02.2023, to the respondents 1 to 3 to cancel the sale deed. Since no action was taken on the petitioner's representation, the present writ petition is filed. 2/5

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 3.

In the light of the limited scope of prayer sought for in this writ petition and the submissions of the learned counsel on either side, this Court without going into the merits of the case, directs the respondents 1 to 3 to consider the representation of the petitioner dated 09.02.2023 and pass appropriate orders on merits and in accordance with law, after giving opportunity of hearing to all interested parties as expeditiously as possible preferably within a period of three months from the date of receipt of copy of this order.

5. With the above directions, the writ petition is disposed of at the admission stage itself. However, there shall be no order as to costs. 20.10.2023 ksa-2 Index : Yes / No Speaking Order : Yes / No 3/5
