A.No.876 of 2023 A.No.876 of 2023 in C.S.No.1 of 2022 SENTHILKUMAR RAMAMOORTHY,J By order dated 11.01.2023, the application filed by the 1st, 4th and 5th defendants to set aside the order dated 14.09.2022 was allowed on condition that a sum of Rs.15,000/- be paid as costs. Such order was complied with as recorded on 31.01.2023. This application is consequential thereto.
2. On instructions, learned counsel for the plaintiff states that he has no objection to this application being allowed in view of the payment of costs earlier. However, he submits that the 2nd and 3rd defendants, who are represented by the same counsel, have not taken any steps to set aside the ex parte order.
3. On examining the affidavit in support and being satisfied that sufficient cause is shown, this application is allowed and the delay of 256 days in filing the written statement by the 1st, 4th and 5th defendants is condoned. Consequently, the Registry is directed to receive the written statement. List on 27.02.2023.
