The petition has been filed to direct the first respondent change the investigation officer to conduct enquiry upon the petition G2/39187/19/1009/2019.

2.It is seen that a complaint was lodged by the petitioner making allegations against the 2nd respondent herein before the Chief Minister, and subsequently it was forwarded to the concerned Superintendent of Police. Thereafter, it was referred before the very same 2nd respondent police for enquiring about the entire allegations as against the 2nd respondent, which cannot be enquired by the same officer.

3.Considering the above facts and circumstances of the case, the first respondent is directed to forward the complaint lodged by the petitioner to engage some other Police Officer for enquiry.

4.With the above directions, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed.
