This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner under the guise of enquiry and not to register a case under Section 110 Cr.P.C.
2.
Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents. 3.
The learned counsel for the petitioner submitted that there is no case pending against the petitioner and the respondents are frequently harassing the petitioner by threatening that Section 110 Cr.P.C. proceedings will be initiated against him. Since the petitioner is not involved in any offence such proceedings against the petitioner is unnecessary and hence the petitioner has sent a representation dated 02.11.2022 to the respondents but without considering the same they continue to harass the petitioner.
4.
The learned Government Advocate (Crl. Side) appearing for the respondents would submit that the petitioner was once history sheet 2/4
rowdy and the representation given by the petitioner on 02.11.2022 is under consideration.
5.
Since the respondents had acknowledged the representation given by the petitioner, the petitioner has also stated that as of now there is no case pending against him and he is not involved in any criminal offence for the past 15 years, I feel it is appropriate to direct the third respondent police to consider the representation of the petitioner dated 02.11.2022 and do the needful in accordance with law within a period of four weeks from the date of receipt of a copy of this order. 6.
With these observations, this Criminal Original Petition stands disposed of.
