ORDER

This contempt petition has been filed to punish the respondent for wilful disobedience of the order passed by this Court in WP.No.22349 of 2024 dated 02.08.2024 thereby directing the respondent to calculate and settle the interest at the rate of 6% per annum from 01.06.2022 to 24.05.2024 on belated settlement of contributory pension scheme of Rs.26,25,410/- within a period of eight weeks from the date of receipt of the order. 2.

The learned counsel for the respondent would submit that this Court, without ordering notice to the respondent, passed the order. The delay in disbursement of CPS amount was not on the fault of the respondent. He filed affidavit to that effect that there was audit objection under para No.34 / 2013-2014 concerning the petitioner's appointment as Superintendent. Pursuant to the letters of the respondent dated 24.03.2023 and 10.05.2023, the Government approved and ratified the action of the respondent to appoint the petitioner as Superintendent and thereafter recommended thereby dropping the audit objection raised on his appointment. Further, the Deputy Collector, Local Fund Audit, University of Madras dropped the audit objection by its communication dated 26.12.2023 and informed to the 2/4

respondent. Further, by the communication dated 05.03.2024, the Deputy Director of Local Fund Audit, University of Madras had pointed out certain deficiencies while seeking contributory pension scheme final settlement clearance of the petitioner. Thereafter, the defects were found to be rectified and accordingly, the file of the petitioner has been cleared by the Local Fund Audit proceedings dated 03.05.2024. Immediately thereafter, the contributory pension scheme settlement was made to the petitioner by the proceedings dated 24.05.2024. Therefore, there was huge delay. 3.

In view of the above, no contempt is made out against the respondent. Further, the respondent also filed writ appeal against the order passed by this Court and it is pending at the condone delay petition stage. As such, the contempt petition is dismissed. However, the petitioner is at liberty to work out his remedy subject to the result of the writ appeal in the manner known to law.
