... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.Suresh Srinivasan, the learned counsel for the Appellant, Mr.Saravana Bhavan, Assistant Vice President of the appellant Insurance Company and the first respondent / claimant are present. None appeared for the second respondent. Upon mutual discussion, negotiation, mediation and conciliation between both the parties, they arrived at a compromise to settle the matter as follows:- TERMS OF SETTLEMENT The present appeal arises against the order passed by the Motor Accidents Claims Tribunal II, Court of Small Causes, Chennai in MCOP No.3037 of 2021 dated 22.09.2023. The first respondent herein claimed a compensation of Rs.40,00,000/- for the injuries suffered by him due to the accident. The Motor Accidents Claims Tribunal awarded a compensation of Rs.31,83,100/-.

2. Pending the appeal, the parties have settled the matter for a sum of Rs.27,00,000/- (Rupees Twenty Seven Lakhs only) in full quit. The first respondent Mr.V.Majini and Mr.Suresh Srinivasan, learned counsel representing the appellant Insurance Company and Mr.Saravana Bhavan, Assistant Vice President of the appellant Insurance Company stand by the settlement arrived at.
3. The Civil Miscellaneous Appeal is disposed of in terms of the settlement as aforesaid. The first respondent will be entitled to withdraw the sum of Rs.27,00,000/- out of the sum of Rs.40,91,838/- deposited by the appellant forthwith. The amount over and above Rs.27,00,000/- can be withdrawn by the appellant. The CMA is settled accordingly. Connected miscellaneous petition is closed.
