O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS in Crime No.303 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner herein along with other accused involved in illegal theft and transportation of gravel soil in a vehicle bearing Registration No.TN-28-BJ-5706 and on seeing the respondent police, the petitioner had fled away from the spot leaving the vehcile. Hence, this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the 2/4

respondent police reiterated the prosecution case and on instruction submitted that the total quantity of gravel sand involved in this case is 8 units. He further submitted that the investigation is pending, hence opposed the grant of anticipatory bail to the petitioner.

5. Heard the learned counsels and perused the materials available on record.

6. Considering the quantity of mineral illicitly transported, this Court is not inclined to grant anticipatory bail to the petitioner.
