The petitioners are A1 and A2 in Crime No.361 of 2023, registered under Sections 406, 420 and 468 IPC.

2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) appearing on behalf of the respondent. 3.It is the specific case of the prosecution that the petitioners herein, had held out that they would be able to get a job in the Railways to the de facto complainant and accordingly had received a sum of Rs.21,00,000/-. Very specifically it is stated that the 1st petitioner/A1 had received a sum of Rs.6,00,000/- and the 2nd petitioner/A2 had received a sum of Rs.15,00,000/-. It is stated that a sum of Rs.3,00,000/- alone had been returned back. The learned counsel for the petitioners states that a sum of Rs.9,00,000/- had been returned to the son of the de facto complainant by bank transfer that is an issue which will have to be examined but the very fact that there has been a bank transfer return to the son of the de facto complainant would establish receipt of amounts by the petitioners herein. https://www.mhc.tn.gov.in/judis 1/2

kp There are still more amounts repayable. Investigation will have to be done. At this stage, I am not inclined to grant anticipatory bail, petition stands dismissed.
