O R D E R

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A), 4(1)(B), 4(1)(C) of the Tamil Nadu Prohibition (Amendment) Act, 2024 r/w Section 123 of BNS (328 of IPC) in Crime No.135 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that on 11.08.2025 based on a secret information, the premises of the petitioners was searched and found 70 litres of fermented wash meant for preparing illicit arrack, besides 3 litres of illicit arrack and 15 packets of illicit arrack. Two of the accused, who were present at the place were arrested and these two petitioners are absconding.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they are hailing from a respectable family and have permanent residence. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for anticipatory bail to the petitioners. 2/4

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing for granting anticipatory bail to the petitioners, reiterated the prosecution case and states that the preparation of illicit arrack was in the residence of the petitioners and the investigation is pending.

5. Heard the learned counsels and perused the materials available on record.

6. Considering the facts and taking note of the seizure memo and the FIR, which indicates that the preparation of the illicit arrack was in the residence of the petitioners herein, hence this Court is not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this criminal original petition stands dismissed. 21.08.2025 stn 3/4
