ORDER

This petition has been filed against the order passed by the Court below, allowing the petition filed under Section 311 of the prosecution to recall PW.2 and PW.4 for further examination.

2. The Court below has taken into consideration the fact that recalling PW.2 and PW.4 for further examination is required in order to mark certain documents which was not done on the earlier occasion. Therefore, in the interests of justice and in order to come to a fair decision, it is necessary to recall PW.2 to PW.4. The Court below has also taken into consideration the fact that the petitioner will always have a right to cross examine the witnesses.

3. This Court does not find any illegality or infirmity in the order passed by the Court below and there are no grounds to interfere with the same.

4. In view of the above, this Criminal Original Petition https://hcservices.ecourts.gov.in/hcservices/

is dismissed and the Court below is directed to proceed further with the case and complete the proceedings in C.C.No.7581 of 1994, on the file of the II Metropolitan Magistrate, Allikulam (Egmore), Chennai, within a period of two months from the date of receipt of a copy of this order.
