Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the first respondent to decide the waiver petition on the next date of hearing scheduled on 06.12.2023 or an earlier date as directed by this Court in AIT (SA) No.408 of 2022 in DRAT at Chennai.

(Made by the Hon'ble Chief Justice) Heard Ms.V.Archana, learned counsel for the petitioner.

2. This petition is filed for a limited purpose, that is to direct the Debt Recovery Appellate Tribunal, Chennai to decide the waiver petition on the next date of hearing or at an early date.

3. When the date is already given by the Tribunal for hearing the waiver petition, naturally the Tribunal would hear the application. The petitioner shall make a request to the Tribunal to hear the application expeditiously, which request shall be considered by the Tribunal.

4. In view of that, the writ petition stands disposed of. There will be no order as to costs.
