The petitioner apprehending arrest for the alleged offence under Sections 303(2), 326(a) of BNS and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.459 of 2025, seeks anticipatory bail.
2. According to the prosecution, on 11.08.2025, a mini lorry bearing Registration No.TN 03 V 3804 which was meant to be used for transporting river sand illegally was intercepted. The occupants of the mini lorry were not able to produce any transmit permit and from their information, they found that the lorry belongs to the petitioner and on his instructions, they are transporting river sand illegally.
3. The learned counsel appearing for the petitioner submits that he had no knowledge about the transport of river sand illegally and without his instructions, the driver and his associate had indulged in this act. 2/4
4. The learned Government Advocate (Crl.side) appearing for the respondent Police submits that the petitioner is a habitual offender and similar cases are pending against him. The vehicle as well as materials have already been seized and the confiscation proceedings have also been initiated.
5. Considering the quantum of sand transported and the antecedents of the petitioner, this Court is not inclined to entertain the anticipatory bail petition.
6. Accordingly, this Criminal Original Petition is dismissed. 20.08.2025 ssb 3/4
