ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.06.2025 for the alleged offence under Sections 194(1) of BNSS Act, 2023 and altered to under Sections 194(1) of BNSS Act-2023 @ 25(1A), 25(1AA) of ARMS Act - 1959 r/w Section 103(1) & 61(2) of BNS Act, 2023, on the file of respondent police, seeks bail.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case, as though he was involved in the alleged murder of the deceased Chakravarthi, on the date of the occurrence. He further submitted that the petitioner has been suffering incarceration from 16.06.2025. Hence, he seeks the grant of bail to the petitioner.

3. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the deceased was an Advocate by profession, and that there was a previous motive arising out of the murder of Seenu @

Seenuvasan, who was brother of the petitioner. In that case, the deceased had been engaged to secure bail for the accused concerned. With a political motive as well, the present murder occurred as an act of retaliation. The deceased was shot by the accused, and thus it is a case of murder. Hence, he strongly opposed the grant of bail to the petitioner.

4. Considering the gravity of the offence and the existence of a previous motive, it is evident that the petitioner is involved in the shooting of the deceased. If he is released on bail, he may abscond, tamper with the evidence, and hamper the witnesses. Therefore, this Court is not inclined to grant bail to the petitioners.
