JUDGMENT
The writ court granted liberty to the appellant to approach the competent civil court of law to redress his grievances in respect of fraudulent registration of a document under the Registration Act.
2. An application under Section 77A of the Registration Act was filed. Since it was not entertained, writ petition came to be instituted
3. The Hon'ble Division Bench of this Court in the case of M.Kathirvel vs The Inspector General of Registration, reported in 2024 (4) CTC 769 struck down Section 77A of the Registration Act and therefore, application filed under the said provision is not maintainable. An aggrieved person has to approach the competent civil court for seeking appropriate remedy. The writ court also affirmed the said position. Thus, no interference is required.
4. Granting liberty to the appellant to approach the civil court, the present intra court appeal in WA No.431 of 2023 stands dismissed. No costs. 2/4
