..Respondents Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 3rd respondent to Survey the measurement of temple lands comprised in survey No. 29 / 14, 29/27, 29/30, 29/34 and retrieve the same in the name of Arulmigu Irattai Pulyamarthur Mariyamman temple situated at Irattai Maruthur village, Raman Nagar, Mettur Taluk Salem District subsequently direct the respondents to remove the unauthorised constructions put forth by the 2nd respondent thereon pursuant to the petitioner representation dated 26.08.2022.

Mr. T.Arunkumar, Addl. Govt. Pleader Order (Order of the Court was made by S.M.Subramaniam J.) The learned Additional Government Pleader based on instructions would submit that a fair price shop has been constructed and the Authorities found that it is a temple land.

2. Therefore it is for the temple to set out their claims if any exists. However, the subject property is not Government Poramboke land or the land belongs to the Government and thus, the question of issuing direction to evict the encroachments would not arise at all. However, it is for the temple to initiate appropriate actions if the temple lands are under un-authorised occupation.

3. With the above directions, this Writ Petition stands disposed of. No costs.
