Respondent PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, to direct the Sub-Court, Poonamalee to expedite hearing of the EP.No.105 of 2010 in OS.No.213 of 1993 on the file of Sub-Court, Poonamallee on day to day basis and dispose of the same within the time frame fixed by this Court.

ORDER

This Civil Revision Petition is filed seeking a direction to the Sub-Court, Poonamallee, to dispose of the EP.No.105 of 2010 within a stipulated period fixed by this court.

2. Having regard to the limited prayer made in this revision petition, this court is inclined to dispose of the same even without notice to the respondent.

3. The petitioner herein has filed a suit for specific performance in O.S.No.213 of 1993 on the file of the Sub-Court, Poonamallee and obtained a decree. The said decree was confirmed by this court in A.S.No.197 of 2002 by a judgment and decree dated 15.06.2010. Thereafter, the petitioner herein has filed E.P for execution of the decree for specific performance in E.P.No.105 of 2010. It is also stated that as per the decree, the petitioner had deposited a balance consideration before the Execution Court as early as in the year 2017.

4. The perusal of the E-court entry filed in the typed set of papers would suggest that the counter in EP was filed on 19.04.2017 and thereafter, the matter has been adjourned from time to time without any substantial progress .

5. Having regard to the fact that the EP is of the year 2010, this court is inclined to issue a direction to the court below to dispose of the EP.No.105 of 2010 within a period of six months from the date of receipt of a copy of this 2/4

order.

6. With the above direction, this Civil Revision Petition is disposed of. No costs.
