The petitioner who was arrested and remanded to judicial custody on 20.08.2022 for the alleged offence under Sections 8(c), 22(c) of NDPS Act, 1985 in Cr.No.532 of 2022, seeks bail.

2. There are totally five accused in this case, in which the petitioner is arrayed as A1. The case of the prosecution is that the petitioner along with other accused were found in selling of LSD stamp-16, which contains 0.270 grams. Hence, the case.

3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that when the petitioner went to the respondent police station to comply the condition, he was falsely implicated in this case. Further, that the petitioner is in custody from 20.08.2022. Hence prays for grant bail to the petitioner.

anu 4.The learned Government Advocate (Crl.Side) would submit that the petitioner was found in selling of 0.270 grams of LSD stamp-16 which is of commercial quantity. He would submit that the petitioner has got 11 previous cases, similar in nature. Hence, he vehemently opposed to grant bail to the petitioner.

5. Considering the gravity of offence committed by the petitioner and the previous cases pending against the petitioner, this court is not inclined to grant bail to the petitioner.
