O R D E R
The captioned Writ Petition (hereinafter referred to as "WP" for the sake of brevity, convenience and clarity) has been filed seeking the issuance of a Writ of Mandamus, directing the third respondent to include the name of the petitioner in the panel of promotion for the post of Assistant Executive Engineer (Electrical) with effect from the year 2006. Page Nos.2
2. The grievance of the petitioner is that, although several of his juniors have been promoted to the post of Assistant Executive Engineer (Electrical), his name was not considered for such promotion.
3. Mr. C. Ramkumar, learned counsel appearing for the respondents, submitted that the petitioner's name was not considered for promotion owing to the pendency of a departmental enquiry. He further submitted that, pursuant to the enquiry, the competent authority had imposed a penalty on the petitioner, which stood as an impediment to his promotion. However, he fairly submitted that the case of the petitioner will be duly considered in accordance with law. The submission made by the learned counsel for the respondents is taken on record.
4. It is relevant to note that, by a separate order dated 22.08.2025 passed in W.P.No.31053 of 2017, this Court has set aside the order dated 27.04.2016 imposing penalty on the petitioner. In view of the said development, the impediment for considering the petitioner's promotion no longer survives. Accordingly, the petitioner is entitled to be considered for promotion to the post of Assistant Executive Engineer (Electrical) on par Page Nos.3
with his juniors.
5. In the light of the above, the captioned Writ Petition is disposed of with a direction to the first respondent to consider the case of the petitioner for promotion to the post of Assistant Executive Engineer (Electrical), with effect from the date on which his juniors were promoted to the said post. The entire exercise shall be completed within a period of three (3) months from the date of uploading of this order on the official website of this Court.
6. It is made clear that the petitioner shall also be entitled to all consequential monetary and service benefits, with effect from the date on which his juniors were promoted.
