COD is qua 170 days in filing Criminal Appeal being Crl.A.SR.No.55490 of 2022 against the judgment dated 29.11.2021 in S.C.No.29 of 2021 on the file of Magalir Neethimandaram, Tiruppur.

2. Mr.R.Muniyapparaj, learned Additional Public Prosecutor accepts notice for the respondent and submits that no other appeal has been preferred by the petitioner.

4. Learned counsel, adverting to paragraph No.5 of the support affidavit submits that difficulty in arranging and preferring appeal owing to family circumstances is the reason for delay.

5. Considering the facts and circumstances of the case and nature of the matter, we have no difficulty in accepting the reason qua COD prayer.

6. Captioned Crl MP ordered as prayed for. Delay condoned. There shall be no order as to costs.
