Crl. O.P. No.26128 / of 2024 P. DHANABAL.J., The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 66C and 66 read with 43 of the Information Technology Act, 2000, in Crime No.2178 of 2024 on the file of the respondent police, seek interstate anticipatory bail.

The case of the prosecution is that on 30th August 2024 and 10th September 2024, the 1st petitioner unlawfully accessed the email server of World First Courier, particularly the email account vinod@worldfirst.in and exported confidential professional emails without authorization. A notification from the email service provider, Zoho, raised concerns regarding unauthorized access, prompting the complainant to approach the Cyber crime Police, Hyderabad, leading to the registration of FIR. Hence the case.
3. Learned counsel appearing for the petitioners would submit that the petitioners have nothing to do with the aforesaid alleged offence and a false case has been foisted against themt. The defacto complainant has filed a counterblast complaint to the complaint filed by the 2nd petitioner
against her husband and others before the Inspector of Police, Nungambakkam Police Station in CSR No.334 of 2024, pending investigation. The petitioners are now taking steps to file anticipatory bail before the Court at Hyderabad. Hence, prayed to grant inter state anticipatory bail to the petitioners.
4. Though notice served to the 1st respondent, there is no representation. The learned Government Advocate appearing for the 2nd and 3rd respondents has not seriously objected.

Taking into consideration the facts and circumstances of the case, considering the nature of offences and that the present complaint is the counter complaint as against the complaint given by the 2nd petitioner against the defacto complainant and the petitioners have to take steps for bail and they have to go to Hyderabad, this Court is inclined to grant interstate interim anticipatory bail to the petitioners for a period of six weeks to enable them to move the concerned Court.
6. Accordingly, interim interstate anticipatory bail is granted to the petitioners for a period of six weeks, on condition that the petitioners shall
surrender before the learned XIV Metropolitan Magistrate, Egmore, Chennai-8, within a period of fifteen days from the date on which the order copy is made ready and the petitioners shall each execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioners shall approach the competent Court and seek appropriate relief.
