ORDER
This writ petition has been filed for direction directing the respondents 1 and 2 herein to fix fee for the courses namely (i) Diploma in General Nursing and Midwifery (ii) Diploma in Parmacy (iii) Diploma in Health Inspector and (iv) B.Sc., Allied Health Sciences including B.Sc., in Medical laboratory Technology, Radiology and Imaging Technology, Cardiac Technology etc., conducted by the colleges run by the petitioner.

The petitioner Trust has established several educational institutions such as Excel Nursing College, Excel College of Pharmacy &
Excel Institute of Health Science, thereby educating more than ten thousand students in and around Erode, Tirupur, Salem and Namakkal District. These institutions have been conducting the following courses from the academic year 2017 onwards :- (i) Diploma in General Nursing and Midwifery - intake 60 (ii) Diploma in Pharmacy - intake 60 (iii) Diploma in Health Inspector - intake 80 (iv) B.Sc., Allied Health Sciences (including B.Sc., in Medical Laboratory Technology, Radiology and Imaging Technology, Cardiac Technology etc., - intake 40. 3.
However, the respondents 1 & 2 failed to fix fee structure for courses conducted by the respective self financing colleges. The fee fixation for the educational courses involves determination of tuition and other fees based on various factors including cost of tuition fee, maintenance of infrastructural and institutional facilities. Due to the nonfixation of fees, the students who belong to Schedule Caste and Schedule Tribe are not able to get their scholarship. Therefore, fixation of fee for the above courses is just and essential.

Heard the learned counsel appearing on either side and perused the materials placed before this Court. 5.
It is seen that these courses are conducted not only by the petitioner's institutions but also other institutions all over the State of Tamil Nadu. Further for those courses, so far no fee has been fixed for the self financing colleges. On receipt of the several representations, including the petitioner's representation, the second respondent committee vide its letter dated 14.07.2025, has forwarded the same to the first respondent to take appropriate action to fix the fee. 6.
In view of the above, the first and second respondents are directed to fix the fee for the courses namely (i) Diploma in General Nursing and Midwifery (ii) Diploma in Parmacy (iii) Diploma in Health Inspector and (iv) B.Sc., Allied Health Sciences including B.Sc., in Medical laboratory Technology, Radiology and Imaging Technology, Cardiac Technology etc., conducted by several self financing colleges in Tamil Nadu, within a period of three months from the date of receipt of a copy of this Order.

With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs.
