The present Criminal Original Petition is filed to call for the records in C.C.No.119 of 2017 pending trial on the file of learned Judicial Magistrate No.I, Udumalpet and quash the same.
2. The learned counsel for the petitioner seeks permission of this Court to withdraw the present petition and has also made an endorsement to that effect. Further, the learned counsel for the petitioner seeks to dispense with the personal appearance of the petitioner.
3. In view of the submission and the endorsement made by the learned counsel for the petitioner, this petition is hereby dismissed as withdrawn. Considering the specific allegation, viz., that the documents in which the entire prosecution relied on, has not been furnished, the personal appearance of the petitioner is dispensed with.
