When the matter is taken up for hearing, there is no representation for the petitioner.

2. The Learned counsel for the respondent 2 to 4 states that, a copy of transfer petition was not furnished.

3. The Learned Government Advocate (Crl.Side) for the respondent states that, on completion of investigation, final report filed and examination of witnesses commenced. The prosecution has already examined two witnesses.

4. The averments in the transfer petition that prosecution has not taken effective steps to produce witnesses before the Trial Court appears to be incorrect. Hence, this Criminal Original Petition is dismissed. The respondent police is directed to expedite the marshalling of witnesses and complete trial preferably within a period of four months. Consequently, connected Miscellaneous Petition is closed.
