ORDER
The petitioner has filed the present Writ Petition praying for issuance of a Writ of Mandamus to direct the respondent to review the suspension order, vide Roc-E-3747/2025/A2, dated 31.01.2025 as per the Government Order, vide G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022 and G.O(D).No.450, Municipal Administration and Water Supply Department, dated 01.08.2023 and by considering the representation dated 14.07.2025.
2. The petitioner was working as Special Tahsildar at Gangavalli Taluk Office, Salem District. Based on the complaint registered by one D.Manjula, a case in Crime No.1/AC/2025, dated 29.01.2025 was registered on the file of the Deputy Superintendent of Police, Vigilance and AntiCorruption, Namakkal (in-charge), Salem, and a trap was laid and the petitioner was arrested on 29.01.2025. Pursuant to the same, the petitioner was suspended from service by an order dated 31.01.2025 with effect from 29.01.2025. Seeking to revoke the suspension, the petitioner has made representation on 14.07.2025 in the light of G.O.Ms.No.81, Human 2 / 5
Resources Management (N) Department, dated 04.08.2022 and G.O.(D).No.450, Municipal Administration and Water Supply Department, dated 01.08.2023 and the decision of the Honourable Supreme Court in Ajay Kumar Choudhary Vs. Union of India in Civil Appeal No.1912 of 2015 (arising out of SLP Civil No.31761 of 2013), dated 16.02.2015. Since the said representation is pending consideration, the petitioner has approached this Court by way of present writ petition.
3. Heard both sides and perused the materials available on record.
4. Learned Special Government Pleader appearing for the respondents would submit that the petitioner was arrested in a trap case on 29.01.2025 and he has been suspended by an order dated 31.01.2025 and the respondent is awaiting records from the Vigilance and Anti Corruption Department, Namakkal (in-charge), Salem.
5.In the light of the pendency of the representation before the respondent, without expressing anything on merits, the respondent is 3 / 5
directed to consider the representation of the petitioner dated 14.07.2025 in the light of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022 and G.O.(D).No.450, Municipal Administration and Water Supply Department, dated 01.08.2023 and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
