The petitioner, who was arrested and remanded to judicial custody on 08.09.2023, in Crime No.341 of 2023, for the offences punishable under Sections 294 (b), 323, 324, 374, 506 (ii) IPC and Sections 7, 8, 11(1) & 12 of POCSO Act, 2012 and Sections 75 and 78 of Juvenile Justice Act, 2015, seeks bail.

2.The learned counsel for the petitioner stated that petitioner is an innocent person and he has been falsely implicated in the case. Thus, he seeks bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that, second accused is the mother of the victim, who is a young boy. Petitioner is running a hospital and the second accused is working under him. It is further stated that the petitioner had sexually abused the victim boy. The victim had reiterated the commission of offence during the course of recording of statement under Section 164 Cr.P.C. It is also stated that the final report is ready to be filed. Thus, he prayed for dismissal of this petition.

sli 4.Let the final report be filed. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
