This matter is taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for the revision petitioner.
2. The learned counsel for Revision Petitioner would submit that this Court by an order dated 01.11.2023 dismissed the above C.R.P.. However, the learned counsel would submit that instead of granting four months time, the time to vacate the premises to the revision petitioner may be modified. Accordingly, the matter is listed today.
3. Considering her submissions, para 4 of the order shall be substituted as follows :- "4. Records perused. On perusal of the order passed by the learned Rent Control Appellate Authority, it would reveals that even during the pendency of the proceedings in R.C.O.P.No.560 of 2017, she filed a Rent Control Original Petition in RCOP.No.4 of 2017 under Sec. 8(5) of the Act for 1/3
deposit of monthly rent and the same was ordered, but even that order was also not complied as per the observation made by the learned Rent Control Appellate Authority. So, the fact reveals that during the pendency of the proceedings, she committed willful default and the same was rightly observed by the learned Rent Control Appellate Authority, which needs no interference. So, I do not find any merit in this Civil Revision Petition. However, time for the period of two months is granted to the Revision Petitioner to vacate the premises from today. Accordingly, this Civil Revision Petition is dismissed. No costs. Consequently, connected Civil Miscellaneous Petition is closed."
4. Registry is directed to incorporate above correction in the Order of this Court in C.R.P.No. 3979 of 2023 dated 01.11.2023 and issue fresh order copy to the Revision Petitioner.
