The above C.M.P. has been filed to condone the delay of 262 days in preferring the appeal suit.

In this case, Mr.A.S. Vijay Anand, learned counsel undertook to file vakalath for the contesting 1st respondent and after hearing him, the delay of 1303 days in re-presenting the appeal suit was condoned on payment of costs of Rs.2500/- and the same has been paid.

In the above C.M.P, which has been filed for condoning the delay in filing the appeal suit, though the name of the counsel for the 1st respondent is printed in the cause list, there is no representation on his behalf.

Hence, on being satisfied with the reasons stated in the affidavit filed in support of the miscellaneous petition, the delay of 262 days is condoned and the petition is ordered.
