A.No.2040 of 2024 and CS.No.133 of 2023 C.V.KARTHIKEYAN, J.

This application has been filed by the 2nd defendant seeking to condone the delay of 6 days in filing the written statement.

2. In the affidavit filed in support of the Judges Summons, it has been stated that the suit has been filed for partition and after receipt of the suit summon, a few documents had to be searched and handed over to the learned counsel to prepare the written statement and hence there was a delay of 6 days. Though the learned counsel for the plaintiff wanted to file counter, taking into consideration the facts of the case, the application seeking to condone the delay of 6 days in filing the written statement stands allowed.

3. Registry is directed to take on record the written statement filed by the 2nd defendant.

4. All the defendants have filed their written statements, list the suit on 04.06.2024 for framing of issues.
