Respondent(s) PRAYER : Criminal Original Petition filed under section 528 of BNSS to pass an order of direction, directing the respondent police to transfer the investigation concerned in Crime No.239 of 2025 on the file of the 2nd respondent to any other competent investigation agency to conduct a free and fair investigation and to file a final report within a stipulated time and to pass such further or other orders as may deem fit and proper.

ORDER

This Criminal Original Petition has been filed to direct the first respondent to transfer the investigation concerned in Crime No.239 of 2025 on the file of the second respondent to any other competent investigation agency to conduct a free and fair investigation and to file a final report within a stipulated time.

2. The petitioner is the defacto complainant and the deceased is his mother. The petitioner and the accused are neighbours. The allegation against the accused is that they had abused and intimidated the victim, due to which she consumed poison and subsequently died. The grievance of the petitioner is that though the First Information Report has been registered, there is no progress in the investigation. Hence, the present petition has been filed for the aforesaid relief.

3. The learned Government Advocate [Criminal Side] on instructions submitted that the investigation is almost completed and they are yet receive reports from the Forensic Department and after receipt of the same, the final report will be filed.

4. Considering the above facts and circumstances, the Court is of the view that this is not a fit case for transfer of investigation. Let the second respondent complete investigation expeditiously and file the final report.
