Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to pass appropriate orders on the application of the petitioner dated 25.08.2022. O R D E R

The petitioner herein seeks a direction to the respondents to pass appropriate orders on the application of the petitioner dated 25.08.2022.

2. It is the case of the petitioner that the property with an extent of 1 acre 30 cents situated in S.No.139, and S.No.91/1B totally measuring 2 acres 15 cents at Nemilichery Village, Alandur Taluk, Kancheepuram District, originally belonged to the petitioner's father's grand father Kanniga Pillai. After the death of Kanniga Pillai, one of his son namely Ethiraj Pillai, without knowledge of other legal heirs got the patta for the property in his name and 2/5

also alienated certain properties. Therefore, the petitioner's father Venkatraman submitted an application on 06..02.2013 before the third respondent seeking cancellation of the patta issued in the name of Revathi, who is the daughter of Ethiraj Pillai. The petitioner's father died subsequently and thereafter, there is no progress. Therefore, the petitioner filed instant representation dated 25.08.2022 before the third respondent seeking cancellation of the patta issued in the name of the said Revathi without consent of other legal heirs of Kanniga Pillai and also sought for issuance of joint patta in the name of all legal heirs and the said application has not been considered. Hence, the petitioner is before this Court.

3. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents 1 to 4 would submit that the representation of the petitioner will be considered, on its own merits, within a time frame fixed by this Court.

4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to consider the representation of the petitioner dated 25.08.2022 3/5

and pass final order, on its own merits, within a period of 8 weeks from the date of receipt of copy of this order, after issuing necessary notice to the petitioner, fifth respondent and other interested parties.

5. With the above direction, this Writ Petition is disposed of. No costs.
