The present Civil Miscellaneous Petition is filed to permit the petitioner/first respondent to withdraw the entire amount already deposited by the appellant/Insurance Company to the credit of the M.A.C.T.O.P.No.2657 of 2019 on the file of the Motor Accidents Claims Tribunal, (II Court of Small Causes), Chennai, pending disposal of the above appeal.

2. Since the appellant has contended that the entire negligence cannot be fixed on the appellant as the claimant has also contributed to the negligence, this Court passed an order to deposit 50% of the amount and granted an order of interim stay.

3. Today the claimant has come forward with a petition to withdraw the deposited amount.

4. Considering the nature of the matter, the petitioner/first respondent is permitted to withdraw the entire 50% amount deposited.

5. Accordingly, this Civil Miscellaneous Petition is ordered. (J.N.B., J.) (R.K.M., J.) 22.10.2024 asi Note: List the appeal on 12.11.2024 "for final hearing".
