ORDER

The above writ petition is filed for the following relief : " To issue a Writ of Mandamus directing the respondents 1 to 3 to approve/ratify the proposal submitted by the fourth respondent dated 12.02.204 and 01.06.2025 by regularizing the period of absence from 09.03.2018 22.12.2021 with monetary benefits to the petitioner and disburse the arrears of salary, due and payable to the petitioner from 23.12.2021 to 18.07.2023 within a time frame fixed by this Court."

2.1 The petitioner was appointed as Secondary Grade Teacher in the fourth respondent-School on 23.08.1993. She was promoted as Secondary Grade Headmistress on 01.06.2004. For certain reasons, she had gone on medical leave from 19.03.2018 to 18.04.2018. When she reported to duty on 19.04.2018, the Secretary of the fourth respondent-School, did not permit her 2/6

to join duty. On 01.10.2018, the petitioner was served with order of dismissal. On the sheer persistence of the petitioner, she was finally reinstated in service on 23.12.2021, on certain conditions. Thereafter, the School Committee forwarded a proposal dated 12.02.2024 to the third respondent seeking approval for regularising the leave period of the petitioner along with monetary benefits. The same remained unattended by the respondents. 2.2 Thereafter, on 23.07.2024, the fourth respondent sent a representation to the first respondent to pass orders in regularizing the petitioner's leave from 09.03.2018 to 22.12.2021 and also to sanction her salary from 23.12.2021 to 18.07.2023. However, the same was not considered to date. Hence, the petitioner is before this Court to issue a mandamus to the first respondent to direct the second and third respondents to approve / ratify the proposal sent by the fourth respondent-School.

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents.

4. Considering the grievance of the petitioner that there was inaction on 3/6

the part of the respondents 1 to 3 to ratify the proposal submitted by the fourth respondent on 12.02.2024, which was pending before them for more than 18 years, and also the representation of the fourth respondent dated 23.07.2024 was not given effect to, and the records would also reveal that the fourth respondent had resubmitted its proposal on 01.06.2025 to the respondents and no action is forthcoming, this Court deems it appropriate to issue necessary directions to the respondents 1 to 3 to consider the relief claimed by the petitioner.

5. Accordingly, the writ petition is allowed and a mandamus is issued to the respondents 1 to 3 to act on their part accordingly and pass necessary orders within a period of three months from the date of receipt of a copy of this order. No costs.
