Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents herein 1/6

to consider and pass orders on the petitioner's representation dated 25.01.2025 with regard to allow the petitioner to re join duty as sanitary worker NMR with all consequential service and monetary benefits within a time frame.

O R D E R

The Writ Petition is filed for the following relief: "directing the respondents herein to consider and pass orders on the petitioner's representation dated 25.01.2025 with regard to allow the petitioner to re join duty as sanitary worker NMR with all consequential service and monetary benefits within a time frame".

2. The petitioner would submit that he was appointed as a Sanitary worker on 11.05.1997 by the Executive Officer, 2/6

Karambakkam Panchayat. Thereafter, his service was merged with Chennai City Corporation in the year 2011. It is the case of the petitioner that he was infected with Covid twice. He took treatment for both the occasions and he was cured. Thereafter, on 24.09.2022 he fell ill due to Lumba Spondylosis. Therefore, the petitioner was unable to discharge his duty due to severe back pain and he undergone treatment for 15 months.

3. The petitioner would submit that he appeared before the 2nd respondent on 02.02.2024 and requested him to allow the petitioner to rejoin duty. The 2nd respondent by proceedings dated 24.06.2024 rejected his request. Therefore, on 25.01.2025 the petitioner made a representation to the 1st respondent seeking permission to rejoin duty. However, there is no response. Therefore, the petitioner is before this Court.

4. Heard the learned counsels on the either side and perused the records.

Considering the fact that the petitioner was severely infected by Covid as well as Lumba Spondylosis and also the fact that the petitioner has rendered more than 25 years of service in the respondent corporation, the 1st respondent is directed to consider the representation of the petitioner Sympathetically and pass orders, within a period of 2 months from the date of receipt of a copy of this order.

6. The Writ Petition is allowed with the above direction. No costs.
