Writ Petition filed under Article 226 Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 3 herein to provide police protection to the petitioner and other mosque representatives from the respondents no.4 to 12 while discharging the duties at Masthan Aulia Dargah pursuant to the representation dated 09.08.2025 sent to the respondents 1 and 2. The present Petition has been filed seeking police protection for functioning as Muthavalli.

2. Heard the learned counsel appearing for the petitioner, learned Government Advocate (Crl.Side) appearing for the respondents 1 to 3 and perused the documents placed on record.

3. It is the case of the petitioner that as against the appointment of the petitioner as Muthavalli, the 4th respondent has filed a petition before the Wakf Tribunal. The Wakf Tribunal has in fact, originally, granted the stay of the order of the Wakf Board, which has been challenged before this Court in C.R.P. No.3214 of 2025, whereas this Court has granted stay of the order of the Wakf Page 2 / 4

Tribunal, therefore, according to the petitioner, he is entitled for police protection.

4. As the petitioner has already filed C.R.P. No.3214 of 2025, he has to work out his remedy only before the same Civil Revision Petition, since issue with regard to the appointment of Muthavalli is pending before this Court, at this stage, this Court cannot direct the police to accord protection.
