Civil Revision Petition filed under Article 227 of Constitution of India, seeking to direct the I Additional District and Sessions Judge, Cuddalore to dispose O.S.No.7 of 2020 within a stipulated time fixed by this Hon'ble Court.

ORDER

The defendants 5 and 6 in the suit filed for partition and separate possession in O.S.No.7 of 2020 before the learned I Additional District and Sessions Judge, Cuddalore, who have no objection for preliminary decree being passed, have come up with the present revision petition seeking expeditious disposal of the said suit.

2. In view of the limited relief sought for by the petitioners, notice to the respondents is dispensed with.

3. Learned counsel for the petitioners submits that the suit is of the year 2020 and the same is pending for the past five years. Learned counsel further submits that, some of the parties in the suit are no more and steps are due for bringing on record the Legal heirs of the deceased parties.

4. In the light of the above submission, this Court directs the I Additional District and Sessions Court, Cuddalore to complete the Page No.2 of 4

process of impleading of all necessary legal representatives of the deceased parties within a period of two weeks from the date of receipt of a copy of this order and after completing the amendments that are necessary, consequent to the death of one of the plaintiffs and one of the defendants, amendments as well as the pleadings shall be completed within a period of four weeks thereafter. The trial Court, thereafter shall frame issues within a period of two weeks and expedite the trail and dispose of the suit finally on merits and in accordance with law on or before 31.03.2026, after hearing the parties.

5. Accordingly, this Civil revision petition stands allowed with the aforesaid directions. No costs.
