O R D E R

The petitioner, who was arrested and remanded to judicial custody on 25.01.2025 for the alleged offence under Section 8(C) R/w. 20(b)(ii)(C) and Section 25 of Narcotic Drugs and Psychotropic Substances Act, 1985 @ 8(C), 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985 in Crime No.52 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was found to 1/4

be transporting 25 kgs of ganja in two vehicles (A1 transported in a Jeep; A2 transported in a two-wheeler) and both the vehicles were intercepted and police have recovered 20kgs of ganja from A1 vehicle and 5kgs of ganja from A2 vehicle. It is further revealed that they purchased ganja from Karnataka and brought it to the border District of Coimbatore. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is in custody from 25.01.2025 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that this is the second bail application and that the petitioner is in custody from 25.01.2025. However, he submitted that the petitioner is having five previous case in which, one case of similar in nature. Hence, he oppose to grant bail to the petitioner on the ground that ganja seized herein is commercial quantity.

5. Considering the fact that a huge quantity of contraband involved in this case is commercial quantity, this Court is of the view that the petitioner 2/4

has to satisfy the twin conditions as contemplated under Section 37 of NDPS Act, and further it is reported that the petitioner is having five previous cases out of which one case of similar in nature, this Court is not inclined to grant bail to the petitioner.
