PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents herein from forming or laying road in the petitioner's patta lands in S.F. ORDER
The present Writ Petition is filed for issuance of a Writ of Mandamus to forbear the respondents herein from forming or laying road in the petitioner's patta lands in S.F. Nos.444/2A1B, 444/2A2B, 444/2A3B and 444/2A4 situate at Muthanampalayam Village, Tiruppur Taluk and District except under due process of law.
2. At the outset, Mr.Abishek Murthy, learned Standing Counsel appearing
for the respondents 1 and 2 would submit that now there is no proposal by the Tiruppur Corporation to lay a road at Muthanampalayam, a land measuring SF.No.444/2 A4. Further, he would submit that, if the Tiruppur Corporation intend to lay the road construction works in the above said land, the same would be done by following the legal guidelines. The learned Standing Counsel has also referred to the counter affidavit filed by the Tiruppur Corporation, wherein, it has been stated as under:
10) I further submit that, Tiruppur Corporation, Muthanampalayam, SF No. 444/2 A4 land is being used as road by the public. Further, as per the Updated Land Survey Record and Resurvey Record, a land measuring SF No. 444/2A4 of Tiruppur Municipal Corporation, Muthanampalayam, as per Patta No. 649 stands in the name of Nachimuthu counter (1) Amaravathi counter (2) Palanisamy counter (3) has been filed jointly and used as a joint cart track. As per the present Revenue Department records, land SF No. 444/2 A4 of Tiruppur Corporation, Muthanampalayam, is stands in the name of Petitioner Indrani under Patta No. 868.
11) 1 further submit that, at present, the Tiruppur Corporation has not taken up the laying Road at Muthanampalayam, SF No. 444/2 A4, if Tiruppur Corporation will take up the road construction works in above said land, following the legal guidelines.
