Mr.V. Arumugam, District Judge (Retd.) Mrs. A. Alamelu, Advocate Crl.RC.No.673 of 2021 (Revision Petition against the Judgment passed in Crl.A.No.13 of 2017 dated 02.03.2019 by the Principal Sessions Court, Namakkal, confirming the order of the learned Judicial Magistrate, Paramathi made in STC No.264/2013 dated 17.02.2017 convicting the petitioner U/s. 138 of N.I Act to undergo simple imprisonment for a period of one year and shall pay compensation of Rs.2,000/- indefault to undergo simple imprisonment for a period of two months and set aside the same by allowing the above CRl.R.C.

Both the parties are present. Mr.Deepan Uday, learned counsel for petitioner and Mr.W.Camyles Gandhi, learned counsel for respondent is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT This criminal revision petition has been filed against the Judgment made in STC No.264/2013 on the file of the Judicial Magistrate, Paramathi dated 17.02.2017 confirmed in Crl.A.No.13/2017 on the file of the Principal Sessions Court at Namakkal, dated 02.03.2019.

2. Criminal Revision Case No.673 of 2021 in Criminal Appeal No.13 of 2017 is filed before this Court and that both the parties are present and the case was filed under Section 138 of N.I Act agreed between the parties for a sum of Rs.3,00,000/- mentioned in the cheque could be paid by the petitioner in Crl.R.C.No.673/2021 to the respondent. It is further represented that the amount was already handed over to the respondent by way of cheque vide cheque No.987227 and the same is recorded.

3. The Compromise Memo is duly signed by both the parties is filed

before this Court and the same is recorded.

4. Recording the terms of the compromise memo filed by the both parties, the Criminal Revision Petition is disposed of. P.Sankar Counsel for the petitioner V.S.Duraisamy Counsel for the respondent This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
