Petition filed under Article 226 of The Constitution of India, praying to issue a Writ of Mandamus directing the 3rdr respondent to consider the representation of the petitioner dated 29.07.2021 and direct the 3rd respondent to sanction and reimburse the medical expense of Rs.7,82,300/- incurred by the petitioner.

ORDER

This writ petition has been filed seeking a writ in the nature of mandamus directing the 3rd respondent to consider the representation of the petitioner dated 29.07.2021 for reimbursement of medical expenses of Rs.7,82,300/- incurred by the petitioner for the medical treatment of her husband.

2. The petitioner is a BT Assistant (Tamil) and working in Government Higher Secondary School at Maganoorpatti in Krishnagiri District. She and her family members are covered by New Health Insurance Scheme 2016. Her husband - Thangarasu was hospitalized on 03.07.2021 at Manipal Hospital in Bangalore and underwent a surgery for rheumatic heart disease severe MR and

severe AS on 05.07.2021 and he was discharged on 10.07.2021. He was admitted as inpatient for a total period of 7 days from 03.07.2021 to 10.07.2021. She had in all spent a sum of Rs.7,82,300/- for the treatment of her husband. Her claim for reimbursement was not admitted and the same was kept pending. She had therefore sent a representation on 29.07.2021 to the 3rd respondent seeking reimbursement of medical expenses. That was also not considered till the date of filing the writ petition. In the above circumstances, she had no other option except to file the present writ petition.

3. Heard both sides.

The learned Special Government Pleader bringing paragraph 5 of the counter to the notice of this court submitted that the 2nd respondent / Standing Medical Board had recommended for reimbursement of medical expenses and the District Education Officer, in turn, has sent all the original medical bills along with copy of NHIS ID Card of the petitioner for reimbursement to the insurance company.

5. The learned counsel appearing for the 4th respondent submitted that the petitioner's claim for reimbursement of medical expenses will be considered and appropriate decision will be taken on the claim of the petitioner as expeditiously as possible.

In the light of the above position, instead of the 3rd respondent, the 4th respondent Insurance Company is directed to consider the claim of the petitioner for reimbursement as per rules and take a final decision on the same within a period of two months from the date of receipt of a copy of this order. This writ petition is disposed of accordingly with the above direction. No costs.
