When the matter is taken up today, the petitioner has filed this petition seeking to call for the entire records pursuant to S.C.No.64 of 2021 on the file III Additional District Judge, Gobichettipalayam and quash the same.

2. The learned counsel for the petitioners would submit that the petitioners are accused in S.C.No.64 of 2021 on the file of the III Additional District Judge, Gobichettipalayam for the offences under Sections 294(b), 302, 342 & 34 of I.P.C.

3. When this petition has came up for admission on 08.12.2022, on the request of the learned counsel for the petitioners, the matter has been posted after two weeks, however it has not been listed.

4. Now, it is reported by the learned Government Advocate (Crl.Side) that the first petitioner / first accused in this case has died on 16.11.2023 and the copy of the Death Certificate has also been produced at this stage. All the 27 witnesses have been examined and the case now stands posted for the examination of Investigation Officer on 12.11.2024. 2/4

5. Taking into consideration the stage of the trial, no purpose would be served to entertain this petition.

6. Recording the same, this Criminal Original Petition is dismissed. Consequently, connected Crl.M.P is closed.
