PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned proceedings of the respondent in A.thi.Mu.No.2506/A-1/2021 dated 24.03.2021 and quash the same and consequently the direct the respondent to pay the additional pay from 28.04.2012 to 15.06.2017 with applicable interest to the petitioner within stipulated time.

The writ petition is filed for the relief herein below set out: "calling for the records relating to the impugned proceedings of the respondent in A.thi.Mu.No.2506/A-1/2021 dated 24.03.2021 and quash the same and consequently the direct the respondent to pay the additional pay from 28.04.2012 to 15.06.2017 with applicable interest to the petitioner within stipulated time."
2. The brief facts which has culminated in the filing of this writ petition are set out below:
2.1. It is the case of the petitioner that he was working as Physical Education Director Grade-I at R.C Government Girls Higher Secondary School, Ondiputhur, Coimbatore District. At that time, as per the instruction of the Respondent, the petitioner had taken full additional charge in respect of the Post of District Inspector of Physical Education, Coimbatore District on 27.04.2012 and the petitioner had worked as District Inspector of Physical Education as full additional charge upto 30.05.2019 and he attained the age of superannuation on 30.05.2019.
3. As per G.O.Ms.No.122 Personnel and Administrative Reforms (Fr.IV) Department dated 03.10.2011, the payment to the Officer of full additional charge to be paid at the rate of 1/5 of the pay drawn in the regular post or half 2/5
of the minimum pay of the additional post, whichever is lesser and in pursuance of the said G.O, the petitioner had made representation to the respondent by requesting to pay additional pay for the additional post. As per Na.Ka.No.2947/41/2019 dated 12.06.2019, the petitioner had received one year, 11 months and 15 days additional charge amount. But the petitioner had worked in the said additional Post of District Inspector of Physical Education from 27.04.2012 to 30.05.2019 and in such circumstances, the petitioner is entitled to receive the additional pay for the additional post from 27.04.2012 to 30.05.2019, however, the respondent had not paid for the period from 27.04.2012 to 15.06.2017. Hence, the petitioner had made a representation dated 26.02.2021 to the respondent to pay the additional pay for the additional post from 28.04.2012 to 15.06.2017. But the respondent had rejected the same. Hence, the petitioner is before this Court.
4. Heard the learned Counsels on either side and perused the records.
5. It is seen that the impugned order cannot be termed as a rejection order inasmuch as the respondents have only sought certain certificates and documents from the petitioner. Without complying with the request, the 3/5
petitioner straight away had moved this writ petition seeking to quash the said order. The same cannot be entertained. On submission of the requested documents that is sought for, the respondent shall process the request.
6. Accordingly, this Writ Petition is dismissed. Consequently the connected miscellaneous petition is closed.
