ORDER

The present writ petition has been filed for a Writ of Mandamus, to direct the respondent herein to consider and pass orders on merits and in accordance with law on the representation submitted by the petitioner dated 22.08.2024 with regard to promotion to the post of Special Sub Inspector of Police from the year 2024 on par with his batchmates.

2. Heard Mr.G.Bala and Daisy, learned counsel for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the respondents.

3. The Petitioner states that he joined the Tamil Nadu Police Services as Grade II Police Constable on 24.05.1999 and was promoted as Grade-I in the

year 2009, and further as Head Constable in the year 2015. He was due for promotion to the post of Special Sub-Inspector of Police in the year 2024. The petitioner states that on 05.12.2011, he was imposed with a punishment of stoppage of increment for one year without cumulative effect and the punishment was over on 05.04.2013. Thereafter, there was no currency of punishment and the same has no bearing on his further promotions. But his promotion to the Post of Head Constable was unduly delayed from the year 2014 to 2015 and his further promotion has also been delayed.

4. In this regard, the Petitioner had submitted a representation to the Superintendent of Police on 11.06.2014 and the same was rejected on the ground that he availed Medical leave. He stated that availing leave would not amount to an act of misconduct. Thereafter, the petitioner submitted a representation on 22.08.2024, seeking promotion on par with his batchmates. Though he has maintained a good service record and is eligible under G.O.Ms.No.559 dated 07.12.2021, no orders have been passed on his representation so far. Hence, this writ petition.

Considering the facts and circumstances of the case and in view of the limited prayer sought for in this writ petition, this Court, without going into the merits of the matter, directs the respondent to consider the case of the petitioner and pass orders on the representation submitted by the petitioner dated 22.08.2024 on its own merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. In fine, the writ petition stands disposed of. However, there shall be no order as to costs.
