ORDER
The present writ petition has been filed for a Writ of Mandamus, seeking a direction to the respondents to pass order on the petitioner's representation dated 26.06.2025 submitted by the petitioner to revoke the order of suspension issued by the 2 nd respondent herein in proceedings No.Na.Ka.01/2025 dated 19.04.2025 in light of G.O.MS. No.81, Human Resources Management (N) Department dated 04.08.2022 issued pursuant to the Supreme Court's ruling in Ajay Kumar Choudhary vs. Union of India (Civil appeal no. 1912/2015) and the Full Bench decision in P. Kannan vs Commissioner of Municipal, Administration ( 2021 4 CTC 1).
2. Heard M/s.T.Dharani, learned counsel for the petitioner and Mr.A.N.Purushothaman, learned Special Government Pleader for 2 nd respondent.
3. The petitioner states that he was appointed as Salesman on 01.08.1997 and was working at the Noothencheri Ration Shop when he was placed under suspension by the 2 nd respondent vide proceedings in Na.Ka.No.01/2025 dated 19.04.2025, on the allegation of aiding in illegal transfer of PDS rice and sugar. A criminal case was also registered against the petitioner, and he has been under suspension from 19.04.2025 onwards. The petitioner submitted a representation on 26.06.2025, seeking revocation of his suspension, but the same has not been considered till date. Hence, the petitioner is constrained to move the present writ petition.
4. Considering the facts and circumstances of the case and in view of the limited prayer sought for in this writ petition, this Court, without going into the
merits of the matter, directs the 2 nd respondent to consider the case of the petitioner and pass orders on the representation submitted by the petitioner dated 26.06.2025 in the light of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, issued pursuant to the judgment of the Hon'ble Supreme Court in Ajay Kumar Choudhary v. Union of India (2015) 7 SCC 291, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
5. In fine, the writ petition stands disposed of. However, there shall be no order as to costs.
