ORDER

The Transfer Civil Miscellaneous Petition has been filed by the petitioner / wife seeking transfer of the petition for divorce filed by the 1/4

respondent / husband in HMOP No.101 of 2025 pending on the file of the Subordinate Court, Ponneri to the Principal Family Court, Puducherry.

Heard the arguments of the earned counsel on either side. 3.

According to petitioner, she is residing at Puducherry and she has two children aged about 2 years and 4 years. She has expressed difficulty in undertaking long travel to Chennai for the purpose of court hearing and hence seeks transfer.

4. The learned counsel for the respondent vehemently opposed the prayer for transfer on the ground that the petitioner herein filed the instant transfer petition only to harass the respondent. 5.

It is settled law that in cases of matrimonial dispute, the preference shall be given to the convenience of the wife. 6.

In the case on hand, the petitioner / wife is residing at Puducherry and the petitioner is also having two children aged 2 years and 4 years respectively. In such circumstances, it may not be possible for her to undertake such a long travel to Chennai. Therefore, this Court is inclined to allow the prayer for transfer. 2/4

Accordingly, the Transfer Civil Miscellaneous Petition is allowed and H.M.O.P.No.101 of 2025 pending on the file of the Subordinate Court, Ponneri is withdrawn and transferred to the file of the Principal Family Court, Puducherry.
