The petitioner is A2 in Crime No.205 of 2023, registered by the respondent police on 05.05.2023 for the offences punishable under Sections 8(c) & 22(c) of NDPS Act. The petitioner had been arrested on execution of Prisoner in Transit warrant on 18.05.2023.

2. It is stated that on 05.05.2023, the respondent had received an information about selling of Methaqualone at Keeraithottam Park and at that particular spot A1, A3 and A4, who are in totally possession of 790 grams of Methaqualone had been taken into custody.

3. It is to be noted that 500 grams and above would be considered as commercial quantity. Thereafter, on information given by the said accused persons, the name of the petitioner also reflected in the FIR and it is the contention of the other accused, who had been secured that it was the petitioner, who supplied the said Methaqualone with directions to earn money by selling it.

4. The learned counsel for the petitioner stated that there is no previous case under NDPS Act pending against the petitioner herein but however, there are several IPC cases had been registered against the petitioner herein.

5. In view of that particular fact and more particularly because it is stated that the petitioner is the supplier of the said contraband, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
