O R D E R

Mr.D.Ravichandar, learned Special Government Pleader, who takes notice on behalf of the respondents. With consent, the main Writ Petition is taken up for final disposal at the stage of admission itself.

This Writ Petition has been filed seeking for a direction to the first respondent herein to conduct enquiry and give fresh patta, comprising in S.No.153/17, of an extent of 0.58 cents of agriculture land, Periya Kattupakkam Village, Thirukazhukundram Taluk, Chengalpattu District by considering the petitioner's representation dated 21.10.2024, within a reasonable time framed by this Court.

3. The learned counsel for the petitioner would submit that the 2/6

petitioner is the owner of the aforesaid property and is in continous possession for the past 39 years. Further, he would submit that at the time of UDR the revenue records was modified, by mistakenly altering the patta land as Tharisu. But in the registration department has mentioned the above survey number as Patta and also quoted the guideline value. Hence, the petitioner made a representation to the 1st respondent on 21.10.1996 to conduct enquiry and issue fresh patta infavour of the petitioner. However, the petitioner's representation was not considered by the respondent till date, thus the present writ petition has been filed before this Court.

The learned Special Government Pleader appearing for the respondents would submit that the petitioner has given the representation to the 1st respondent, but the competent authority to consider the same is the 3rd respondent and therefore the petitioner may be directed to give fresh representation to the 3rd respondent and on such representation being made, the 3rd respondent would consider the petitioner's representation by conducing enquiry within a time frame fixed by this Court, which was agreed to by the learned counsel for the petitioner. 3/6

In view thereof, the writ petition stands disposed of with the direction to the petitioner to give fresh representation to the 3rd respondent within a period of two weeks from the date of receipt of a copy of this order and on such representation being made, the 3rd respondent is directed to conduct enquiry and pass orders on the said representation, within a period of 8 weeks from the date of receipt of a copy of this order after giving prior notice and reasonable opportunity of hearing to the petitioner as well as other parties concerned. No costs.
