ORDER

(1)Mrs.C.Meera Arumugam, learned Additional Government Pleader accepts notice on behalf of the respondents 1 to 3. With the consent of both the learned counsels, the main writ petition is taken up for final disposal at the admission stage itself.

(2)As no adverse order is passed against the 4 th respondent, notice to the 4 th respondent is dispensed with.

(3)The writ petition is filed for a mandamus directing the respondents 1 to 3 to conduct enquiry and take action against the 4th respondent for abuse of power, commission of irregularities and misappropriation of funds of

Venpakkam village Panchayat, by considering petitioners representations dated 02.06.2025 and 30.07.2025.

(4)The petitioner was elected as Vice President of Venpakkam Village Panchayat, Kancheepuram District. The petitioner states that he was discharging his duties without any blemish. While so, the 4 th respondent, without getting necessary approvals and permission from the 1 st respondent, decided to lay roads in various areas of the Village Panchayat. The 4 th respondent, awarded the tender in favour of one BAS Enterprises on 24.05.2025, without the concurrence and approval from the 1 st respondent.

When the petitioner questioned the 4 th respondent, he was informed that the project of laying of roads was undertaken by the private Company from the funds allocated under the Corporate Social Responsibility [CSR]. The petitioner further came to know that the 4 th respondent, had indulged in several acts of misappropriation of Panchayat funds and therefore, the petitioner submitted representations on 02.06.2025 and 30.07.2025, to the respondents 1 to 3, to conduct enquiry and to take appropriate action against the 4 th respondent. As the said representations were not responded to, the

petitioner filed the above writ petition for the aforesaid relief. (5)Heard both sides and also perused the materials placed on record. (6)In view of the facts and circumstances of the case, without delving into the merits of the matter, this Court deems it appropriate to direct the 3 rd respondent, to consider and pass orders on the petitioner's representations dated 02.06.2025 and 30.07.2025, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. In the event the 3 rd respondent finds that there is veracity in the petitioner's accusations, then the 3 rd respondent shall initiate appropriate action as deemed fit, and in accordance with law, within a period of four weeks thereafter.

(7)The writ petition is disposed of with the above direction. No costs. 28-08-2025
