Learned Counsel for the Appellant submits that the Appeal had been preferred against the judgment and decree passed by the learned IV Additional Judge, City Civil Court by allowing the petition in I.A.No.5 of 2022 in O.S.No.4837 of 2021 by judgment dated 16.03.2023 rejecting the plaint. Aggrieved by the same, the Plaintiff had preferred this Appeal.

2. Learned Counsel for the Appellant submits that he is not pressing the C.M.P filed by the Appellant seeking stay of the judgment and decree passed by the learned IV Additional Judge, City Civil Court.

3. In view of the submission and endorsement made by the learned Counsel for the Appellant, the petition is dismissed as not pressed.
