The petitioner seeks bail in Crime No.153 of 2023 originally registered under Section 174 Cr.P.C., and later altered to Sections 302 & 201 of IPC. The petitioner had been arrested and remanded to judicial custody on 13.08.2023.

2. The petitioner is the 1st accused and it is stated that the petitioner had intimacy with A2, who is the wife of the deceased, owing to which, both the petitioner and the 2nd accused had strangulated the deceased with coconut coir and tied a stone around him and pushed him into a well. This constituted offences not only under Section 302 but also Section 201 of IPC, screening of evidence. There is also a strong motive behind the said offence.

3. The learned counsel for the petitioner states that the petitioner is a sick person. If that be so, the Superintendent of Jail, Central Prison, Salem, may arrange appropriate treatment to be given to the petitioner herein.

4. Taking into consideration all these factors, I am not inclined to grant bail to the petitioner herein. Accordingly, this Criminal Original Petition stands dismissed.
