PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to call for the records relating to C.C.No.2169 of 2016 on the file of the VII Metropolitan Magistrate, Chennai and quash the same.

This petition has been filed to quash the charges in C.C.No.2169 of 2016 pending on the file of the VII Metropolitan Magistrate, Chennai against the petitioner for the offence under Section 138 of the Negotiable Instruments Act.
2. The main contention of the learned Counsel for the petitioner is that there is no authorization given by other partners to file the complaint. Besides, the respondent is also charging exorbitant interest. These aspects have been pleaded to quash the entire complaint. That itself clearly indicate that one way or other to drag the trial, these type of petitions have been filed which ought not to have been entertained. In fact entertaining these type of petitions mechanically will lead to pendency of the cases before the Trial Court. Hence, I am of the view that the very entertainment of the cases for the sake of filing itself is not proper in the Court of law. Hence, I do not find any merits in this petition.

3. Accordingly, this Criminal Original Petition is dismissed. Consequently connected miscellaneous petitions are closed.
